BancMarc Policies and Procedures (9/9/08)
Current BancMarc business procedures are:
1) Members will sell products and services at their prevailing prices for 100% BancMarc credit to other members in good standing presenting a current BancMarc Membership Card.
2) Members enter into BancMarc transactions on a voluntary basis. BancMarc is not responsible for quality of products/services, timely delivery, prices, warranties, or commitments not kept by other BancMarc members. Members should exercise the same discretion in entering into BancMarc transactions as in ordinary business transactions. Disputes between Members may be arbitrated by BancMarc upon request of either Member in the dispute.
3) All sales must have an authorization number and a signed BancMarc voucher at time of purchase in order to receive credit.
4) Buyers must identify themselves to the sellers as a BancMarc member prior to making purchase arrangements.
5) Sellers must submit signed and authorized invoices to BancMarc within 5 days of the transaction so that accounts may be maintained on a current basis.
6) Purchases by members must be limited to the amount of BancMarc dollars in the buyers account. Members carrying a deficit balance may not refuse any reasonable offer.
7) BancMarc will only be responsible for commitments made in writing by authorized BancMarc officers.
8) BancMarc reserves the right to cancel the membership of any member engaging in any unethical practices whatsoever.
9) BancMarc privileges will only be extended to those members maintaining their dues on a current basis.
10) Any member whose membership is terminated agrees to prepay commissions up front and spend any earned dollars for products and services offered by other BancMarc members within a reasonable amount of time. A member indebted to BancMarc at the time of termination agrees to pay any deficit amount in cash within 10 days of business at no interest. Also, the BancMarc member will pay all collection fees including attorney fees.
11) BancMarc rules state all members must trade at 100%. However, if two members agree to trade part cash and part BancMarc, the seller, cash recipients, agrees to pay at time of dollar transfer, 15% cash commission on cash part of deal.
12) BancMarc rules prohibit back to back trading outside of BancMarc. If any member is found trading back to back, BancMarc reserves the right to collect commissions in cash that would have been owed to BancMarc and reserves the right to cancel memberships of those members that were involved.
13) BancMarc members will have a confidential access code to our Website. Members will be instructed not to release this code to anyone and will lose internet access if they do.
14) BancMarc is not responsible for gift certificates purchased and not used before the expiration date or if clients go out of business before a gift certificate is used. BancMarc is also not responsible for gift certificates mailed at member’s request.
15) BancMarc requires members to call our office and get an authorization number before providing services or products to other BancMarc members. If this is not done and members call for an authorization number after products or services have been provided, BancMarc members may not have money in their account to authorize the transaction. Seller is responsible for other payment method.
16) BancMarc gives our clients options on how to pay the cash commissions and fees due on this account. BancMarc will honor Checks, Cash, or Credit Cards. If a member is past due on their fees, BancMarc reserves the right to collect commission at time of purchase either cash or charge their credit cards for the amount owed. Because of our Industry, products are received prior to commission settlement so we ask that all payments are due upon receipt of statement. If not received within 15 days, an 18 % interest fee will be added to your commission and a late fee is added on past due monies at $10.00 a month. If an account goes 60 days past due we will ask for credit card payment to continue purchasing. If there is a problem on payment, contact us immediately. We honor your business, please honor ours.
17) BancMarc will provide members with sales receipts, monthly detail statements, and a BancMarc Card. Your 1099-B year-to-date sales and year-to-date purchases will be provided at the bottom of your December statement each year.
18) BancMarc reserves the right to amend these Trading Rules and Regulations. BancMarc shall give ten days written notice of any such changes. Acceptance thereof by member will be affected, whether in writing or, by failure to give BancMarc written objection thereto within such ten days time. Further use of the membership card shall connote acceptance of the changes and the then current Trading Rules and Regulations.
